Mafell AG is a public limited liability company organized under German law (“Mafell,” “we,” “our,” or “us”) that manufactures and sells timber framing tools, fine woodworking tools, accessories, and spare parts related thereto, including through its distributors that are authorized by Mafell to provide warranty, maintenance or repair services to Mafell customers.  A list of our authorized service centers is set forth on https://www.timberwolftools.com/mafell-authorized-service-centers (the “Authorized Service Centers”).  Timberwolf Tools Corporation, a Delaware corporation, (“Timberwolf”) is an Authorized Service Center of Mafell.  This Limited Product Warranty (“Limited Warranty”) applies only to Mafell-branded timber framing and fine woodworking tools with a serial number, including as set forth on Timberwolf’s website https://www.timberwolftools.com/mafell (the “Products”); this Limited Warranty does not apply to any spare parts or accessories for the Products.

THE PRODUCTS ARE PROFESSIONAL TOOLS INTENDED FOR COMMERCIAL USE ONLY.  IF YOU PURCHASE OR USE THE PRODUCT(S) FOR PERSONAL, FAMILY, OR HOUSEHOLD PURPOSES, THIS LIMITED WARRANTY DOES NOT APPLY TO YOU AND YOU HAVE PURCHASED THOSE PRODUCTS “AS IS, WITH ALL FAULTS,” AND WITHOUT ANY WARRANTY.  ANY USE FOR PERSONAL, FAMILY, OR HOUSEHOLD PURPOSES VOIDS ALL WARRANTIES.

MAFELL AG - LIMITED PRODUCT WARRANTY POLICY - FOR THE U.S.

THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE.  THIS WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER EXPRESS WARRANTIES, WRITTEN OR ORAL.  NO AGENT, REPRESENTATIVE, DISTRIBUTOR, DEALER, OR EMPLOYEE OF MAFELL OR TIMBERWOLF, THEIR RESPECTIVE DISTRIBUTORS OR ITS AUTHORIZED SERVICE CENTERS HAVE THE AUTHORITY TO INCREASE OR CHANGE THE TERMS OF THIS WARRANTY.

This Limited Warranty and any extension are granted to the original purchaser of the Product (“you” or “your”) and cannot be transferred to another natural person or company (including, but not limited to, the Product’s subsequent owner or transferee of the Product).  This Limited Warranty can also be found online at https://www.timberwolftools.com/mafell-warranty and in the documentation provided with the Product.

We warrant that for a term of one (1) year from the date of purchase of the Product (the “Warranty Period”), we will, at our option and on timely written notice, repair, replace, or refund the purchase price of any Product that had defects in materials and workmanship at the time of purchase (“Defects” or “Defective”).  If set forth in the documentation provided with the Product, the Warranty Period for such Product is extended for two (2) additional years (total of three (3) years) from the purchase date.  In order for such extension to apply, any such Product must be registered online at https://garantie.mafell.de within thirty (30) Days of purchasing the Product.

The Warranty Period is not extended and does not commence anew if we repair or replace the Product.  We may change the availability of this extended Limited Warranty at our discretion, but any changes will not be retroactive.

REGARDLESS OF REGISTRATION OR THE WARRANTY PERIOD, UNDER NO CIRCUMSTANCES DO WE WARRANT THE FUTURE PERFORMANCE OF PRODUCTS.  ALL WARRANTIES IMPLIED BY STATE LAW, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE HEREBY LIMITED TO THE DURATION OF THE WARRANTY PERIOD.  SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

We may fulfill our responsibility under this Limited Warranty through the Authorized Service Centers.  With respect to any Product that is found during the Warranty Period to be Defective at the time of purchase, as determined in our sole discretion, we may elect to repair, replace or refund such Product.  If we elect to repair or replace the Defective Product, we will pay for shipping and handling fees to return the repaired or replaced Product to you.

IN NO EVENT SHALL MAFELL OR ITS DISTRIBUTORS OR ITS AUTHORIZED SERVICE CENTERS BE LIABLE FOR ANY INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOST PROFITS OR REVENUES, OR DIMINUTION IN VALUE.  SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.  OUR LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT.

This Limited Warranty is void if the Product is not used, operated, repaired and maintained in accordance with the Product’s instruction manual or any other instructions provided by Mafell or its Authorized Service Centers regarding the Product.

In addition to as set forth herein, this Limited Warranty does not apply to:

1. Products purchased outside the United States.
2. Normal wear and tear (e.g. consumable parts such as bearings, blades, brushes and chains), normal adjustments, repair or maintenance due to normal wear and tear.
3. Any condition of the Product resulting from repair, maintenance, warranty or other services performed by anyone other than Mafell or as authorized by Mafell.
4. Products that have been partly or entirely disassembled or altered, including any assemblance or combination with non-Mafell branded spare parts, accessories, or components, or damages caused as a result of this.
5. Damages of any kind, including alterations, accidents, impact, abuse, improper operation (e.g. together or in connection with simulated power sources such as transformers or generators), lack of maintenance, exposure to extreme temperatures or conditions, unsuitable storage or transport.
6. Products that have been misused or used in any manner inconsistent with our written instructions, materials, manuals, and warnings.
7. Products used for personal, family, or household purposes.

Should any Defect you believe is covered by this Limited Warranty occur, you must contact Timberwolf during the Warranty Period by email via help@timberwolftools.com or call 1-800-869-4169.  Further information on our warranty services, including on how to process your repair and warranty claims, provided in accordance with this Limited Warranty, may be found by contacting the Authorized Service Centers.  Proof of purchase (in particular, the purchase date) is required.  If no proof of purchase (including the date of purchase) is provided, the manufacturing date of the Product is determined in our sole discretion and used to calculate the Warranty Period.
